TRANSCRIPTION IN ITALY OF A DIVORCE DECREE PRONOUNCED IN A NON-EU COUNTRY

For information on the procedure and documents required for the transcription in Italy of a divorce decree issued in a non-European country, the citizen must get in touch directly with the diplomatic-consular representation located in the country where the divorce was pronounced .

 

TRANSCRIPTION IN ITALY OF A DIVORCE DECREE PRONOUNCED IN AN EU COUNTRY

  • HOW TO REQUEST THE TRANSCRIPTION IN ITALY OF DIVORCE DECREES PRONOUNCED IN BELGIUM BEFORE 01/03/2001?

Italian citizens residing in this consular district and registered with AIRE may submit this request by sending the following documents via THE CONSULAR SERVICES PORTAL FAST-IT

1.Deed of transcription of the divorce decree in the civil status register of the Belgian commune (Acte de divorce/Echtscheiding bij de burgerlijke stand).

2.Certified copy of the Belgian divorce decree to be requested from the competent court. (Copie conforme de l’expédition du jugement/Eensluitend afschrift van het vonnis).

The documents referred to in points 1 and 2 must be accompanied by an official translation into Italian. (LIST OF SWORN TRANSLATORS).

3.Transcription of divorce judgment request form 

4.copy of valid identity document

  • HOW TO REQUEST THE TRANSCRIPTION IN ITALY OF DIVORCE SENTENCES PRONOUNCED IN A EUROPEAN UNION STATE (EXCEPT DENMARK) AFTER 01/03/2001?

It will be necessary through THE PORTAL OF CONSULAR SERVICES FAST-IT:

1.Certificate provided for in Art. 39 of EU Reg. 2201/2003 Annex I to be requested from the Registry of the Court of First Instance that delivered the judgment (Certificat visé à l’art. 39 Tribunal de première instance/Formulier voorzien bij art. 39 Griffie bij de Rechtbank van eerste aanleg). This certificate does not need to be translated into Italian.
2. Transcription of divorce judgment request form 
3. copy of valid identity document

N.B. If the divorce decree was pronounced in absentia or “par défaut” (point 5.4 of art. 39), proof of service of the decree on the opposing party (to be requested from the competent court) must also be attached.

  • HOW TO REQUEST THE TRANSCRIPTION IN ITALY OF DIVORCE JUDGMENTS PRONOUNCED IN A EUROPEAN UNION STATE (EXCEPT DENMARK) AFTER 1 AUGUST 2022?

It will be necessary to send the documentation listed below via THE CONSULAR SERVICES PORTAL FAST-IT:

1.Certificato Allegato II previsto all’art.36 del Regolamento UE 2019/1111 da richiedere presso la Cancelleria del Tribunale di prima istanza che ha pronunciato la sentenza (Certificat visé à l’art. 36 Tribunal de première instance/Formulier voorzien bij art. 36 Griffie bij de Rechtbank van eerste aanleg). This certificate does not need to be translated into Italian.
2. Transcription of divorce judgment request form
3. copy of valid identity document
N.B. If the divorce decree was pronounced in absentia or “par défaut” (point 6 of the certificate provided for in Art. 36), proof of service of the decree on the opposing party (to be obtained from the competent court) must also be attached.
